Are fictional characters just open season to be nude?
The rule is silly but consistent for real people (if you’re PN during the recording… then you’re PN in the recording), but fictional characters probably can’t get a real-world PN registration.
A lot would depend on the copyright for the character and who “they” are. Would the manufacturers be releasing this themselves and selling it or would it be an unofficial nude patch made by fans with potential for them to be prosecuted under copyright laws? This sort of thing has been around since Lara Croft. I could imagine governments introducing a Virtual PN licence to cash in on nude characters that are going to be used for commercial gain. Imagine HMRC or the IRS coming after spnati.net for unpaid registration fees in real life
Well fictional characters aren’t exactly bound by real world laws (or I guess I should say double-fictional characters aren’t bound by fictional laws). There could potentially be some laws or rules touching on this though. For instance in my universe it would probably by acceptable to put a permanently naked character in all-ages media, but nudity by a character who normally wears clothes might still be seen as racy and unsuitable for kids.
Including permanently naked characters would also likely be viewed as a positive inclusive thing, similar to featuring characters from a variety of races IRL. Also I think a couple captions imply permanently naked people can be required to play naked characters or use naked avatars online, but this is probably not a widespread rule. More often the availability of these characters would be something voluntarily naked people agitate for. “I’m PN in real life, I shouldn’t have to wear yucky clothes in the game!”
