I guess the question is, when she gets legs and becomes “human” is she fully nude then or only topless? She wouldn’t own any clothes and mermaids naturally would be nude, but seeing as it’s Disney, who knows?
The Remake is set in the modern day, permanudes and all, and most people agree it’s actually closer to Splash than the original Little Mermaid. Anyway, Ariel is nude when she becomes human, and before she can find Eric a rather overzealous permanude enforcement officer insists on seeing her registry (apparently unregistered nudity is a common problem on that particular beach) and hijinx ensue as a mute and naive Ariel is forced through registration. It’s a running gag through the film that the officer is somehow always present whenever Ariel takes a notion to try on an item of clothing, and when she turns back into a Mermaid at the end the officer is uncertain whether or not that counts as nude or topfree.

She’s actually naked since mermaids only wear bras if anything. So top free = no clothing at all.
